英国《金融时报》2月16日称,欧盟当天宣布对中国铁路巨头中国中车股份有限公司(中国中车)的一家子公司发起“前所未见”的调查,声称其涉嫌利用补贴“扭曲”欧盟单一市场。
据悉,中国中车旗下的中车青岛四方机车车辆股份有限公司(中车青岛四方)参与了保加利亚交通和通信部的招标,该招标涉及20辆电动列车的采购、为期15年的维修协议以及员工培训,市场价值6.1亿欧元。
据悉,这是去年7月欧盟《外国补贴条例》(FSR)生效以后,欧盟委员会根据新法规发起的首次“深入调查”。条例规定,当估计的招标价值超过2.5亿欧元,且企业在最近三年内从至少一个第三国享受了至少400万欧元的“外国财政补贴”时,企业须向欧盟通报自己参与的公开招标。

布鲁塞尔,2月16日

欧盟委员会2024年2月16日宣布,根据《外国补贴条例》的规定,对中车青岛四方机车公司参与保加利亚交通和通讯部价值6.1亿欧元的20辆电动机车公共采购投标行为展开有关外国补贴方面的深入调查。欧盟中国商会对此深感失望并表达严重关切。

中车青岛四方机车公司参与此次保加利亚电动机车公共采购竞标项目达到了《外国补贴条例》规定的强制申报门槛。中车青岛四方机车公司于2024年1月22日提交了完整申报。在对中车青岛四方机车公司的申报进行初步审查后,欧盟委员会声称有充分迹象表明该公司获得了扭曲欧盟内部市场的外国补贴,因此有必要深入调查是否这些外国补贴让中车青岛四方机车公司在竞标中获得不当竞争优势。这是自《外国补贴条例》颁行实施以来对公共采购竞标中的外国补贴展开的“首次深入调查”,也是对中资企业展开的首次此类调查。

欧盟中国商会一贯主张,欧盟机构在实施任何政策工具的过程中,应秉持市场开放和公平竞争的原则,避免对外国企业产生歧视性影响,避免通过向欧盟本土企业在收购交易或者公共采购过程中提供不平等的便利而造成新的竞争扭曲。

在欧盟制定《外国补贴条例》及其《实施细则》的过程中,欧盟中国商会多次积极参与立法和实施细则公开意见征询工作,通过各类形式向欧盟委员会和欧盟立法机关提交反馈意见,表达商会成员企业对该法案实施后对欧盟能否继续保持开放和公平竞争的市场环境以及企业承担不合理的申报义务和成本的多重担忧和关切。

欧盟中国商会广大中资企业长期深耕欧洲,为欧盟经济增长做出极大的贡献。商会希望欧洲市场能够继续保持开放、竞争和公平的营商环境,无论经营者来自哪个国家。

欧盟委员会启动对中车青岛四方机车公司的深入调查向中国投资者到欧盟发展经营传递了负面信号,打击了今后它们继续拓展欧洲业务,开展深入合作的积极性和信心。欧盟中国商会对欧盟自去年第四季度以来包括对中国电动汽车展开反补贴调查在内日益增长的保护主义趋势和滥用政策工具的做法,以及欧盟营商环境日趋政治化表示极大地担忧。

欧盟中国商会将密切关注调查进展,希望欧盟委员会公平公正地对待被调查的中国企业,充分保障中国企业抗辩权利,为中国企业创造非歧视和可预期的市场发展环境。

CCCEU Statement on the European Commission's First In-depth Investigation under the Foreign Subsidies Regulation Targeting CRRC Qingdao Sifang Locomotive


Brussels, February 16, 2024
The Press Release of the European Commission of February 16, 2024 announces that it launches on the same day its first in-depth investigation into the foreign subsidies received by CRRC Qingdao Sifang Locomotive relating to its bidding in a public procurement procedure held by Bulgaria's Ministry of Transport and Communications, concerning the provision of 20 electric “push-pull” trains as well as related maintenance and staff training services, with an estimated value of the contract of around €610 million. China Chamber of Commerce to the EU (CCCEU) expresses its great disappointment and deep concerns with this investigation.

The Bulgarian public procurement project at issue that CRRC Qingdao Sifang Locomotive has participated in meets the threshold of mandatory notification under the Foreign Subsides Regulations. According to the Press Release of the European Commission, CRRC Qingdao Sifang Locomotive filed a complete notification on January 22, 2024. Following its preliminary review of this notification, the European Commission considered it justified to open an in-depth investigation, since there are allegedly sufficient indications that this company has been granted a foreign subsidy that distorts the internal market. This investigation is necessary to determine if such foreign subsidy allows the company to submit an unduly advantageous tender. This is the “first in-depth investigation” into foreign subsidies in public procurement sector since the promulgation of the Foreign Subsidies Regulation. It is also the first of such investigations into a Chinese enterprise.

The CCCEU consistently advocates for EU institutions to adhere to the principles of market openness and fair competition when adopting or applying any policy tools. They should avoid having a discriminatory impact towards foreign companies, or leading to new distortions by offering privileges to the EU local owned companies, for instance in acquisition transactions or public procurement processes.

Throughout the EU legislative process of the Foreign Subsidies Regulation and its Implementing Regulation, the CCCEU actively participated in public consultations on the draft legislation and the draft implementation rules for multiple times. CCCEU provided feedback to the European Commission and the EU legislative bodies in several forms, and expressed its member companies’ multi-folded worries and concerns about the EU's ability to maintain an open, fair, competitive market environment and about the unreasonable reporting obligations and costs imposed on the economic operators after the application of the Foreign Subsidies Regulation.

The CCCEU represents a large number of Chinese owned member enterprises that have been deeply involved in European economy for a long time and have made great contributions to the economic growth of the EU. The CCCEU hopes that the European market will remain open, competitive and fair for all business operators, irrespective of their ownership or origin.

The initiation of an in-depth investigation into CRRC Qingdao Sifang Locomotive by the European Commission has sent a discouraging message to Chinese investors intending to cultivate and operate in the EU market. It has struck their enthusiasm and confidence in continuing to expand their business and carry out in-depth cooperation in Europe. The CCCEU expresses deep concern over the increasing protectionist tendencies and abusive use of policy instruments, including the initiation of the anti-subsidy investigation targeting Chinese battery electric vehicles since the last quarter of 2023, as well as over the growing politicization of the EU’s business environment.

The CCCEU will closely monitor the development of the investigation in question and expects the European Commission to ensure fairness, the right of defense of the subject Chinese enterprise, and a fair, non-discriminatory, and predictable market environment.
